Invitation for Public Comment on the Rules of the New York State Higher Education Services Corporation

Pursuant to the State Administrative Procedure Act, the public may comment on proposed regulations within 60 days of their publication in the New York State Register by the Department of State. The public is encouraged to comment on any proposed rules. Comments must be made in writing and must be submitted according to the instructions provided for each proposal. No special form is required: a handwritten letter or e-mail is acceptable. Due to the high volume of comments received, HESC will be unable to reply to individual submissions. However, all comments will be incorporated into an Assessment of Public Comment and published in the NYS Register with the Notice of Adoption.

To be considered, comments must reach us before the proposed rule is adopted. The law provides for a minimum 60-day public comment period after publication in the NYS Register of every Notice of Proposed Rule Making; and a 45-day public comment period for every Notice of Revised Rule Making. When a time frame calculation ends on a Saturday or Sunday, public comment will be accepted through the following Monday. When a time frame calculation ends on a holiday, public comment will be accepted through the following workday. The Department cannot take action to adopt a rule until the day after public comments are due.

The last date on which the Department will accept public comment on its proposed regulations regarding the District Attorney and Indigent Legal Services Attorney Loan Forgiveness Program is on Monday, August 5, 2024.

ARRC is charged with the task of reviewing newly proposed regulations to examine the issues of compliance with legislative intent, impact on the economy, and impact on affected parties.
